Drug-induced liver
injury is the single most common cause of acute liver failure in the United States, according to the National Institute of Diabetes and Digestive and Kidney Diseases.
If you took Rezulin or Actos and experienced any adverse reactions you may have a valid legal claim.
Rezulin was selected for the United States government's largest diabetes study in June, 1996. It was reported by the L.A. Times that the government doctor who ran the study was also a paid
consultant to Warner-Lambert, the drug manufacturer. In October, 1996, Dr. Graham, the first FDA doctor to test Rezulin warned that Rezulin might harm both the liver and the heart.
Rezulin® was recalled in the United States in March 2000 due to liver toxicity. (England banned Rezulin in December, 1997). At least
63 patients have died of liver failure while taking Rezulin, and many more have suffered liver damage. Warner-Lambert reportedly made $2.1 billion from sales.
Actos and Avandia have not reported similar levels of liver injuries, but the Food and Drug Administration says that the drugs' liver safety profiles have not been fully determined yet. These precautions are recommended by the
FDA:
- a liver function test should be performed before taking Actos or Avandia;
the drugs should not be prescribed in the presence of active liver disease or elevated levels of certain liver enzymes;
patients using Actos or Avandia should have liver function tests every 2 months for the first year, and at regular intervals after that;
the patient's doctor should be immediately alerted at the presentation of any symptoms of liver damage, such as: nausea, vomiting, stomach pain, fatigue, loss of energy, loss of appetite, dark urine,
unusual itching, or jaundice (yellow coloring of eyes and skin).
Rezulin was prescribed for blood sugar control in patients with type 2 diabetes mellitus- (non-insulin dependent diabetes). Actos, or Avandia may also be prescribed for blood sugar control in patients with type 2 diabetes mellitus.
Product liability law and medical malpractice or negligence lawsuits are guided by personal injury law. The primary aim of personal injury law is to provide relief through compensation to
injured parties for the damages incurred. Among the types of recoverable damages are: loss of earning capacity, pain and suffering, and reasonable medical expenses. Damages include both present and future expected
losses.
- Product Liability: Defective products such as prescription drugs which are not properly labeled as to interactions or
other contraindications. Your attorney can evaluate your legal rights and advise you of possible compensation.
- Professional Malpractice: Medical malpractice or negligence may involve delay in treatment or incorrect treatment or missed
diagnosis. Your lawyer can protect your rights and represent your interests.
- Wrongful death: Fatal injuries due to negligence or other liability may bring compensation to heirs or estate. Seek legal
counsel before the statute of limitations becomes an issue.
If you have liver damage or liver failure after or during use of Rezulin, Actos, or Avandia, the maker or manufacturer of the drug may be liable for compensation to you. Your
lawyer can counsel you as to your right to recover damages to help defray the costs of treatment and provide compensation for your pain and suffering.
Drug litigation can be extremely complex, it is best to seek the counsel of a personal injury attorney with experience in this field of law.
If you feel that you are having a reaction to any drug, stop the drug immediately and call your physician. An injured liver presents symptoms like the symptoms of any acute or chronic liver disease.
Symptoms of Liver Disease :
- abdominal pain
- breast enlargement in men
- coughing up or vomiting large amounts of blood
- curling up of the fingers
- dark urine
- fatigue
|
- fever
- hair loss
- jaundice (whites of the eyes and skin appear yellow)
- muscle wasting

- redness of the palms of the hands
|

- shrinking of the testicles

The liver is the chemical plant of your body. It governs drug activity throughout the body. When a drug enters the bloodstream, it is converted by the liver into chemicals that the body can use.
Any toxic chemicals are removed by the liver. These chemicals can attack and injure the liver as well as other organs. A doctor diagnoses drug-induced liver injury by stopping use of the suspected drug and excluding other liver
diseases through diagnostic tests.
L ong-term use of a medication can also cause chronic liver damage and scarring (cirrhosis). Medicines that can cause severe liver injury
include Acetaminophen, which is known as a cause of severe liver injury when taken in large doses - or in small doses when taken with alcohol.
Prior to accepting an insurance settlement, it is generally wise to speak with a personal injury lawyer to evaluate your situation and to ensure that your interests are protected. Most personal
injury attorneys provide free initial consultations and most will only be paid if you win your case and receive a judgment.
Most frequently, personal injury
attorneys will receive a percentage of the settlement awarded to you. Legal advice can save you time, trouble and money and can insure that you are treated fairly.
